Terms of Service — OtterSight

1. Agreement to Terms

By accessing or using OtterSight (the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Service.

The Service is provided by Oliver Strebel-Mark, Emmericher Weg 76a, 47574 Goch, Germany ("we", "us", or "our").

2. Description of Service

OtterSight is a software composition analysis (SCA) platform that provides:

→Software Bill of Materials (SBOM) generation using Syft
→Vulnerability scanning using Grype and enrichment with EU Vulnerability Database (EUVD) data
→Dependency version tracking and drift detection
→Notifications via 300+ channels through Apprise
→A web dashboard for managing repositories and viewing scan results

The open-source OtterSight CLI is a separate project governed by its own MIT license. These Terms apply to the OtterSight Cloud service only.

3. Waitlist

During the pre-launch period, you may join our waitlist to receive early access to the Service.

→Joining the waitlist does not guarantee access to the Service.
→Founding Member pricing (€5/month, locked forever) is offered to the first 100 subscribers subject to availability and our sole discretion.
→We reserve the right to modify or discontinue Founding Member pricing for new subscribers at any time. Existing Founding Members keep their locked rate.
→Waitlist registrations may be removed if the provided email address is invalid or if we are unable to contact you.

4. User Accounts

Account registration and management terms will be published here when the Service launches. Access during the pre-launch phase may be granted by invitation only.

5. Acceptable Use

You agree not to:

→Abuse, disrupt, or place excessive load on the Service or its infrastructure.
→Scrape, harvest, or extract data from the Service through automated means beyond normal use.
→Reverse engineer, decompile, or attempt to extract the source code of the proprietary portions of the Service.
→Use the Service for any unlawful purpose or in violation of any applicable laws.
→Attempt to gain unauthorized access to the Service or its related systems.

6. Intellectual Property

The OtterSight CLI (@ottersight/cli) is open-source software licensed under the MIT License. Its use is governed by that license independently of these Terms.

7. Limitation of Liability

The Service is provided "as is" and "as available" without warranty of any kind, express or implied. We do not warrant that the Service will be uninterrupted, error-free, or that vulnerabilities detected by the Service are complete or accurate.

To the fullest extent permitted by law, we shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service.

8. Termination

Either party may terminate the relationship at any time.

→You may cancel your account at any time from the account settings.
→We may suspend or terminate your access if you violate these Terms.
→Upon termination, your data will be deleted within 30 days of your request.

9. Governing Law

These Terms are governed by the laws of the Federal Republic of Germany. Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the courts in Germany, unless otherwise required by mandatory consumer protection law.

10. Changes to These Terms

We may update these Terms from time to time. We will notify you of significant changes via email or a prominent notice on the website at least 30 days before the changes take effect. Continued use of the Service after changes take effect constitutes acceptance of the revised Terms.
